Minneapolis-born Emmanuel Aranda, 24, is accused of throwing the young child from the mall's shopping mall balcony.
According to a lawsuit, the boy and his mother were in front of the Rain Forest Café when Aranda approached them. The mother had never seen Aranda before, and she asked if she and her son should move.
Instead, Aranda picked up the boy and threw him over the railing, according to the lawsuit.
Aranda told the police he came to The mall had one day earlier intended to kill an adult, but that did not work out according to the complaint.
He returned on Friday and apparently chose the boy.
Aranda told the police he knew what he was planning was wrong. He said he had visited the mall for years and tried to talk to women there, but they refused. Aranda said it had upset him.
