The Government issued a detailed statement on the unprecedented events in the Central Bureau of Investigation (CBI), which excluded two leading officials – Verma and Asthana – from the Cabinet Ministers' Appointment Committee headed by Prime Minister Narendra of all powers Modi, on Tuesday.
"The serious allegations of corruption by senior officials of the CBI against others, which have been extensively reported in the media, have affected the organization's official ecosystem," the statement said.
It added that the "factional feud" environment had peaked in the CBI, leading to a potential loss of credibility and prestige of the agency.
It also affects the work environment of the organization, which has a profound and visible impact on the overall leadership, the statement said.
The move was made on the recommendation of the Central Vigilance Commission (CVC), which had given orders to Alok Kumar Verma, Director and Rakesh Asthana, Special Representative of All Powers, after considering "the extraordinary and unprecedented circumstances".
With the recommendation to the Government, the CVC relied on its powers (under Article 8 of the CVC Act, 2003) to supervise the functioning of the DPSE (CBI), insofar as it relates to the investigation of corruption prevention offenses, 1
"The Indian government has previously evaluated the material and, for the sake of equality, fair play and the principles of natural justice, has decided to divest Alok Kumar Verma, Director, CBI and Rakesh Asthana, Special Director, CBI of their functions, power, Duty and oversight in every respect as Director, CBI and Special Director, CBI, "said the statement.
She added that the government had "carefully examined and evaluated the material provided to it" and was satisfied that there was "an exceptional and unprecedented situation" that required the government to exercise its powers under section 4 (2) of the DPSE Act, which allowed the term of office of the CBI Director to be restricted.
"This was done as a provisional measure and will continue until the CVC finishes its investigation on all issues that have led to the current exceptional and unprecedented situation and until the CVC and / or the Government of India make an appropriate decision have decision in accordance with the law in terms of action as a result of it, "the statement said.
Former Special Representative Asthana filed charges of corruption against Verma in a complaint to the government on 24 August, which was forwarded to the CVC.
The CVC had requested that the CBI send the files of the matters referred to in Astana's complaint to her.
"There were several ways to create such records and, after several adjournments, although CBI assured the Commission on September 24, 2018, to deliver the records within three weeks, despite repeated assurances and reminders, the director, CBI, failed to deliver records / files in front of the commission, "it said in the statement.
The CVC found that the director, CBI, had not cooperated to provide the documents and files he wanted, he added.
"The CVC also noted that the Director, CBI, was not cooperative with the Commission, did not fulfill the Commission's requirements / instructions, and deliberately obstructed the functioning of the Commission, which is a constitutional body, the statement said Government.
