Bethenny Frankel and Jason Hoppy Continues the Courtroom
Published on Monday morning the actress and her businessman on Monday morning for a hearing on Hoppy's request for drug and alcohol tests in court. In August, the exes appeared in court when they continued their custody dispute over their daughter Bryn Hoppy . During the court's appearance, Hoppy's lawyer featured a recent episode of RHONY in which Frankel seemed "intoxicated, ran without clothes, and said she mixed ambien and alcohol." The lawyer said, "Our concern is whether Ms. Frankel could have a substance abuse problem." They demanded drug tests for Frankel.
Hoppy and Frankel did not change when they sat in front of their lawyers in a New York courtroom on Monday.
Hoppy's lawyer said in court if Frankel had nothing to hide "Why will not she undergo a drug and alcohol test She refuses and refuses to fight our movements What does her refusal tell us?" The lawyer also noticed Frankel's Instagram and explained that she had just released a video last week that made her look drunk and veiled her speech. "This is a flashing red light and a siren, if that's what she's doing in public, what's she doing privately?"
In response, the judge noted that Hoppy's lawyer had never voiced these concerns before. Only once did the judge say that there would be a hearing and they took the position that she has drug and alcohol problems. Timing raises the question of what motivation is.
Frankel's lawyer said Hoppy is not only uneven in timing, both parents have said that Bryn is thriving, she does well at school. The drug and alcohol speculation is "harassment". Concerning Frankel's drinking, it was "nothing before the child or with the child. She is on TV, she is entertaining." There's nothing wrong with having a party after starting her jeans. "It is intrusive, there are constitutional problems."

The judge said that when ordered, he will order tests for both parents, adding nothing is wrong with drinking with their friends when the child is not with her.
The judge also mentioned Frankel again, dating back to Friend, Dennis Shields who was found dead in his apartment in August. It was not Frankel's fault if he died at an OD. Shields was mentioned at the last hearing in court in August. Hoppy's lawyer expressed his condolences over the situation, but said: "It has been reported that he died of an oxycodone overdose, our concern is that while death is very sad, there are concerns about Mrs. Frankel's parental judgment," because Shields looked after Bryn even if Frankel was not around. "What does it say about Mrs. Fränels parenting that she would allow this person to look after her daughter? It is very dangerous education."
At the end of the hearing, the judge refused the test request. "There was a tragedy that I think she's trying to exploit, I did not hear a single word where one of the two parties was under the influence of drugs or alcohol during the child, so I think your application will be rejected."
