Joe Giudice has just been shot dead by a judge in his immigration process ̵
1; he must remain incarcerated while his deportation proceed.
Joe had filed a motion for release earlier this month with the court over a videoconference. Now the judge has decided and it is not in his favor.
He will remain detained at the ICE detention center where he has resided since his release from prison in March – the Clinton County Correctional Facility.
Giudice family lawyer James Leonard Jr. tells TMZ, "We are completely devastated, our judicial system has failed this family, and we are now at the mercy of the Third Circle Tribunal they do it. " will bring this man back to his four daughters.
TMZ has broken the story … Joe's homesickness and fatigue are being held behind bars, and he feels he should be released from ICE detention while appealing. Joe says the judge can only see his family, especially if he's in danger of being deported soon.
As we've already reported … Joe was instantly transferred to ICE custody when a judge ordered his deportation to his native Italy after serving a 41-month sentence for conspiring to commit wire and bankruptcy fraud.
Joe appealed the decision and lost he appealed to a higher court again … and there we are now Joe wanted to be home with his family in New Jersey waiting for the judge's final decision.
Joe has the opportunity to appeal this decision within the next 30 days, but Leonard says it's off the table and they just hang on to see what the deportation appeal will look like.
