In the lawsuit, Tommy Martin of Mount Holly claimed that the food restaurant violated its civil rights by not putting enough rösti on its plate.
The 58-year-old black Martin claimed that his skin color meant that he was served less fried potato breakfast.
He submitted the handwritten lawsuit to the US District Court in Charlotte on Friday. Martin said the incident that happened at a Hardee in 2018 in Gaston County made him stupid and scared of the food.

"It's not a question of money," he told the observer. "I just want to be treated fairly."
Hardee & # 39; s declined to comment and said the lawsuit was directed against an independent and operated franchise.
The company told Huff Post that it was aware of the lawsuit and "we" take these allegations seriously.
