Chicago Chief Attorney Kim Foxx was summoned on Friday for his handling of the Jussie Smollett case, according to the Chicago Sun Times.
Foxx, Cook County attorney, will have to appear in court after retirement Appeal Judge Sheila O'Brien filed a petition to special prosecution last week to investigate the Smollett case in which a bill was filed last month the "Empire" actor was dropped for 16 reasons.

Joseph Magats, Foxx's chief representative, was also summoned, and another document demanded that Smollett appear at the hearing, the report said.
O'Brien demanded Foxx, Magats and Smollett create original documents in criminal proceedings to assure the public "that they have not been altered or destroyed throughout the process," reports the Sun-Times.
The petition for a special prosecutor alleged Foxx's handling of the case was "plagued by irregularities".

O Brien argues that Foxx, who is informally retired from the case because she was related to a relative of Smollett during the investigation, she would have a special prosecutor have to appoint.
